There are situations in which your personal information may help us give you better service. For example, we may ask for your personal information when you enter for a chance to win a contest or sweepstakes, or sign up for show updates. At such times, we may collect personal information relevant to the situation, such as your name, mailing address, phone number, email address, and contact preferences. In some cases, we also ask you to provide information for market research purposes to gain a better understanding of our customers and thus provide more valuable service. If you choose to purchase a product or service, we and/or our third-party payment processors will collect your payment information, including, but not limited to, your credit or debit card number, card verification value (CVV) number, and expiration date.

NMMA uses the information that we collect to provide our services and products and to operate our business. We may use and store such information for legitimate and lawful business purposes, for example, in order to:

  • provide a service or product you requested;
  • analyze and evaluate customer needs and interests, and improve the customer experience;
  • notify you of NMMA official business, news, activities, programs, events, meetings, conferences, services, products, and benefits;
  • respond to communications and inquiries that you send to us;
  • promote the safety and security of our services; and
  • for other legitimate and lawful business purposes.

For individuals located in the European Economic Area, we rely on multiple legal bases to collect, use, share, or otherwise process your personal data, including that:

  • you have given consent, which you may withdraw at any time;
  • it is necessary for us to perform a contract with you;
  • it is necessary for us to comply with legal obligations;

  • it is necessary for us to perform a task in the public interest or for our official functions; and/or

Newsletter/Show Updates

If you wish to subscribe to our newsletter or Show updates, we ask for contact information such as your name and email address. While we cannot prevent users from signing up other individuals to receive the newsletter, out of respect for our users' privacy, we provide a way for you to opt out of these communications if you no longer wish to receive them. Please see the Choice section below.

In some of our email messages we use a “click-through URL” linked to content on our website. When a customer clicks one of these URLs, they pass through a web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked simply avoid clicking text or graphic links in the email.

In addition, we sometimes use pixel tags—tiny graphic images—to tell us what parts of our website customers have visited or to measure the effectiveness of searches customers perform on our site. Pixel tags also enable us to send email messages in a format customers can read. And they tell us whether emails have been opened to assure that we're only sending messages that are of interest to you.

Choice

If you no longer wish to receive our newsletter, Show updates, or other email communications that you previously requested from us, you may opt out of continuing to receive such communications at any time by clicking on the “Unsubscribe” link that appears at the bottom of each email or by sending an email to webmaster@nmma.org.

Website Traffic

As most websites do, NMMA's Show website gathers certain information automatically and stores it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time, and clickstream data.

We use this information, which DOES NOT identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole. This helps us to determine how best to provide useful information to customers and to understand which parts of our websites and Internet services are of most interest to them.

Cookies

As is standard practice on many corporate websites, NMMA's Show website uses “cookies” and other technologies to help us understand which parts of our websites are the most popular, where our visitors are going, and how much time they spend there. We also use cookies and other technologies to make sure that our online advertising is bringing customers to our website. We take your privacy very seriously. To help us provide superior service, your personal information may be shared with legal entities related to or affiliated with NMMA who will safeguard it in accordance with this privacy policy. There are also times when it may be necessary for NMMA to make certain personal information about you available to third-party companies that we have a strategic relationship with or that perform work for us to provide products and services to you on our behalf. These companies may help us process information, fulfill customer orders, deliver products to you, manage and enhance customer data, provide customer service, or conduct customer research or satisfaction surveys. NMMA takes reasonable precautions to protect your information, including administrative, technical, and physical security measures, to safeguard your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration, and destruction. When you submit sensitive information via the NMMA Show website, your information is protected both online and off-line. However, please be aware that no method of electronic transmission is completely infallible, and we cannot guarantee its absolute safety. You can help us by also taking precautions to protect your personal data when you are on the Internet. Data Retention

NMMA retains your personal information for as long as necessary to fulfill the purposes for which it was collected as set forth in this privacy policy, unless otherwise required by law. We will retain and use information as necessary to comply with legal obligations, resolve disputes, enforce agreements, and as otherwise set forth in this privacy policy.

Data Transfer

If you are visiting the website or the NMMA Show from outside the United States, please be aware that you are sending information, including personal data, to the United States where our servers are located. That information may then be transferred within the United States or to other countries outside the United States other than your country of residence. Countries other than your country of residence, including the United States, may have data privacy and protection laws that differ from, and potentially provide less protection than, the applicable laws in your country of residence. To the extent that NMMA may be deemed to have transferred personal data outside of the European Economic Area, we rely on multiple legal bases for doing so. For individuals located in the European Economic Area, by providing your personal information, you consent to our use of it in accordance with this privacy policy, including the transfer of your information across international boundaries to jurisdictions anywhere in the world as permitted by applicable law. In addition, we will obtain separate consent from individuals located in the European Economic Area in connection with the provision of certain services that involve the transfer of personal data. By attending an NMMA boat, sport or trade show, you consent to the photographing and videotaping of you, and any minor children accompanying you, by NMMA and any third-party company producing the Show, its agents and the media. You grant NMMA and any third-party company producing the Show and its agents the right to the use of your name and photos, videos, and images (collectively, Images) of you, and the name and Images of any minor children accompanying you, taken before, during or after the Show, in advertising and promotional materials for the Show and/or NMMA, including, but not limited to, on the Internet, without compensation. You agree that no such advertising or promotional materials need be submitted to you for review or approval. You agree that all Images of you or any minor children accompanying you used by NMMA or any third-party company producing the Show and its agents are owned by NMMA and/or such third-party company producing the Show and its agents, and they may copyright materials containing such Images. You release, discharge, and agree to save harmless NMMA and any third-party company producing the Show and its agents from any liability, including, without limitation, any claims for libel or invasion of publicity and/or privacy, in connection with any use of your name and/or Images, and the name and/or Images an any minor children accompanying you, including any alteration of such Images, whether intentional or otherwise.

Acceptance of Privacy Policy Terms

  1. Eligibility. This 2019 Progressive® Insurance Chicago Boat, RV & Sail Show™ Chicago Boat Show Pass Surprise & Delight Sweepstakes (the “Promotion”) is open only to legal residents of the United States including its commonwealths, territories and possessions, with the exception of residents of Rhode Island and New York, (collectively referred to herein as "states"), who are at least 18 years of age or older (except, in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) at the time of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of the National Marine Manufacturers Association, Inc. (“Sponsor”) and its parents, affiliated companies, subsidiaries, suppliers, advertising and promotion agencies, and any and all other companies associated with the Promotion are not eligible to participate or win the prizes (as defined below). Eligibility is also contingent upon compliance with these Official Rules and fulfilling all requirements set forth herein.   2. How to Enter. The Promotion begins at 2:00 p.m. Central Standard Time (“CST”) on January 9, 2019 and ends at 5:00 p.m. CST on January 13, 2019, during the hours that the 2019 Progressive® Insurance Chicago Boat, RV & Sail Show™ (the “Show”) is open to the public (the “Promotion Period”). You may enter the Promotion by any of the following methods (no other method of entry will be accepted):

    1. Chicago Boat Show Pass Method. You may: (1) register for the Chicago Boat Show Pass by web registration at https://cbs19.fishsoftware.com/prereg and download the Chicago Boat Show Pass app to your mobile device where you will receive a Chicago Boat Show Pass QR code; or (2) download the Chicago Boat Show Pass mobile app and complete registration through the mobile app to activate your Chicago Boat Show Pass QR code. Individuals entering the Promotion using such method shall be referred to herein each individually as an “Entrant” and collectively as “Entrants.” While in attendance at the Show during the Promotion Period, Entrants may check in at designated stations within the Show (each, a “Station"), including participating exhibitor booths, which will record Entrant's Chicago Boat Show Pass ("Check In"). One (1) point is given for each Check In at a unique Station during the Show; only one (1) Check In per Station during each day of the Show will be recognized to accrue points for the Promotion. The number of points accrued will determine in which prize category of random drawings ("Tier") the Entrant will be entered.
    2. Alternate Method of Entry (“AMOE Method”). If you do not wish to Check In or attend the Show, you may enter the Promotion by hand-printing your full name, address, city, state and zip code, cell phone, day & evening telephone numbers (including area codes), date of birth and e-mail address (optional) on an 8”x10” piece of paper and mailing it in a sealed envelope with proper postage affixed to: 2019 Progressive® Insurance Chicago Boat, RV & Sail Show™ Chicago Boat Show Pass Surprise & Delight Sweepstakes, c/o National Marine Manufacturers Association, Inc., 231 S. LaSalle Street, Suite 2050, Chicago, IL, 60604 or emailing such information to info@chicagoboatshow.com. AMOE entries must be received by Sponsor prior the conclusion of the Promotion Period. AMOE entries become the property of Sponsor and will not be returned. Individuals entering the Promotion using the AMOE Method set forth above shall be referred to herein each individually as an “AMOE Entrant” and collectively as “AMOE Entrants.” AMOE Entrants may submit only one entry and may not enter using any of the other methods of entry on the same day. In the event an AMOE Entrant also enters using one of the other methods of entry set forth above on the same day, he or she shall be disqualified and ineligible to win on that day. Additional entries beyond the specified limit will be void. AMOE Entrants will be entered to win on each day of the Promotion Period remaining after receipt of an AMOE entry by Sponsor.
  3. Random Drawing. The potential winners of each Tier of prizes in the Promotion will be selected periodically during the Show at random as detailed below (each, a “Random Drawing”). Subject to verification of eligibility and compliance with the terms of these Official Rules, the potential winners will be declared the official winners of the Promotion (each, a "Winner" and collectively, the "Winners"). The decisions of Sponsor are final and binding on all matters relating to this Promotion. Odds of winning depend on the total number of Entrants, AMOE Entrants and Check Ins.

  4. Prize Tiers.

    1. Tier 1: Any Qualifying Entrant (as defined below)* who scanned his/her Chicago Boat Show Pass three (3) or more times is entered in the Random Drawing to win: Chicago Boat, RV & Sail Show Koozie (Prize No. 1).
    2. Tier 2: Any Qualifying Entrant who scanned his/her Chicago Boat Show Pass five (5) or more times is entered in the Random Drawing to win: Chicago Boat, RV & Sail Show Hat (Prize No. 2).
    3. Tier 3: Any Qualifying Entrant who scanned his/her Chicago Boat Show Pass ten (10) or more times is entered in the Random Drawing to win: Chicago Boat, RV & Sail Show Water Bottle (Prize No. 3).
    4. Tier 4: Any Qualifying Entrant who scanned his/her Chicago Boat Show Pass fifteen (15) or more times is entered in the Random Drawing to win: a NorCross Marine Boatbag Cooler (Prize No. 4).
    *A "Qualifying Entrant" is an Entrant who has at least one (1) Check In during the three (3) hours prior to the applicable Random Drawing or an AMOE Entrant.

  6. Prize Conditions. All prize details shall be determined in the sole and absolute discretion of Sponsor. All costs and expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to, any lodging, transportation, shipping, postage, delivery, meals and beverages, gratuities, and other expenses incurred by accepting and using a prize are the sole responsibility of each Winner. Prizes are nontransferable and not substitutable, with no cash redemptions except at the sole and absolute discretion of Sponsor. If any prize (or portion thereof) becomes unavailable, Sponsor reserves the right to substitute another prize of equal or greater value.

  7. Winner Determination, Verification and Notification. Each time an Entrant earns enough points to reach a new Tier he/she will become eligible to win a prize within that Tier. AMOE Entrants will be entered one time in each Tier on each day of the Promotion Period. If an Entrant or AMOE Entrant is one of the randomly selected winners, he/she will receive an SMS message and email notifying him/her (“Prize Notification”). The Prize Notification will (i) inform the Entrant that he/she MUST go to a specific location by a specific time to claim the prize and contact information if the Entrant has any questions; or (ii) instruct the AMOE Entrant that he/she must reply to such message within a specific time and follow all instructions contained therein in order to claim the prize.

    An Entrant (or AMOE Entrant) is not a Winner, even if selected or notified of being a potential winner, unless and until eligibility has been verified. A potential winner must have complied, and must continue to comply, with all terms and conditions of these Official Rules, and eligibility is contingent upon fulfilling all requirements. In the event that a Winner is disqualified for any reason, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries. Once Sponsor determines that a potential winner is eligible, Winners will be announced and prizes will be awarded on-site at the Show to Entrants and will be mailed to AMOE Entrants. In the event that a potential winner does not respond to the Prize Notification within the specified period of time or declines the prize for any reason, a disqualification will result, the prize will be forfeited, and, at Sponsor’s sole discretion and time permitting, an alternate potential winner may be randomly selected from among all remaining eligible entries. Noncompliance with these Official Rules, or the return of the prize (or any portion thereof) or Prize Notification as undeliverable may result in disqualification and prize forfeiture and, at Sponsor’s sole discretion and time permitting, may cause an alternate potential winner to be randomly selected from among all remaining eligible entries.

LaSalle Street, Suite 2050, Chicago, IL, 60604 within 90 days of the end of the Promotion Period. The decisions of Sponsor are final and binding on all matters relating to this Promotion. Odds of winning depend on the total number of Entrants, AMOE Entrants and Check Ins.

  8. Limitations of Liability. By participating in this Promotion and submitting an entry, each Entrant agrees: (a) to be bound by these Official Rules, including all entry requirements; (b) to waive any and all claims against Sponsor and its subsidiaries, affiliates, vendors, advertising or promotional agencies, and distributors, including its parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) for any injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Promotion or from the receipt or use of any prize (or any portion thereof) or any activity or travel related to the receipt or use of a prize (or any portion thereof); and (c) to release and hold harmless the Released Parties from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of such Entrant’s participation in the Promotion or receipt, use, or misuse of a prize. Further, the Released Parties are not responsible for: (a) technical failures of any kind; (b) any incorrect or inaccurate information, whether caused by Entrants, printing or computing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (c) unauthorized human intervention in any part of the entry process or the Promotion; (d) technical or human error which may occur in the administration of the Promotion or the processing of entries that prohibit the Promotion from being conducted as planned; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Promotion or receipt, use, or misuse of any prize. Released Parties are not responsible for: stolen, late, incomplete, illegible, inaccurate, misdirected, lost, misrouted, scrambled, damaged, delayed, undelivered, mutilated, postage-due, or garbled registrations, transmissions, email, or mail; lost, interrupted, or unavailable network, cable, satellite, server, Internet Service Provider (ISP), wireless network, website, or other connections, including those through and/or by any website, availability or accessibility or miscommunications or failed computer, satellite, telephone, cable, or wireless transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or difficulties; wireless service congestion; failures or malfunctions of telephones, telephone lines, or telephone systems, wireless towers, or cellular tower equipment; any error, omission, interruption, defect, or delay in wireless or other transmission, processing, or communication; non-delivery; misdirected, blocked, or delayed email notifications; printing, typographical, or other errors appearing within these Official Rules, in any Promotion-related materials; or any other errors, problems, or difficulties of any kind whether human, mechanical, electronic, network, computer, telephone, wireless service, mail, typographical, printing, or otherwise, relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries, the announcement of prizes, or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Except where prohibited, participation in the Promotion constitutes each Entrant and AMOE Entrant’s express consent to be contacted by Sponsor by telephone, e-mail, and/or postal mail for Promotion purposes. Each Winner, by acceptance of the prize, grants to Sponsor the right to publicize the Winner’s name, likeness, photograph, voice, statements, opinion, hometown and state, and/or other likeness and prize information for promotional, advertising, trade, and/or any other purposes in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation, including on social media websites, without further compensation, payment, consideration, permission or notification, unless prohibited by law.

  11. Suspension. Sponsor reserves the right to cancel, suspend, and/or modify the Promotion Period, or any part of it, if any fraud, technical failure, or other factor beyond Sponsor’s reasonable control impairs Sponsor’s ability to properly conduct the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the non-suspect, eligible entries received up to the time of the cancellation of the Promotional Period. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be in violation of these Official Rules, including, without limitation, any person who tampers with or abuses the entry process or any aspect of the Promotion, attempts to undermine the legitimate operation of the Promotion by cheating, deception, or other unfair practice, intends to annoy, abuse, threaten, or harass another Entrant or any representative of Sponsor, or otherwise violates the Official Rules. Any attempt to undermine the operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  12. Disputes. Except where prohibited, Entrant agrees that this Promotion and these Official Rules and any action or omission relating to or arising out of this Promotion is governed by the laws of the State of Illinois, without regard to the conflicts of law provisions, and is subject to the laws, rules, and regulations of the United States and these Official Rules. As a condition of participating in this Promotion, participants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Chicago, Illinois having jurisdiction, and participants submit to the jurisdiction of the courts located in Illinois. Further, in any such dispute, under no circumstances will participants be permitted to obtain awards for, and hereby waive all rights to claim, punitive, incidental or consequential damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (e.g., costs associated with entering), and participant further waives all rights to have damages multiplied or increased.

  13. Entrant’s Personal Information. Information collected from Entrants is subject to Sponsor’s Privacy Policy, which can be found at http://www.nmma.org/privacy-policy (“Sponsor Privacy Policy”) as well as the FISH Technologies/National Marine Manufacturers Association Chicago Boat, RV & Sail Show Privacy Policy (“Show Privacy Policy”), which can be found at www.chicagoboatshow.com/privacy (the Sponsor Privacy Policy and the Show Privacy Policy are collectively referred to herein as the “Privacy Policies”). In the event of a conflict between the Sponsor Privacy Policy and the Show Privacy Policy, the terms of the Show Privacy Policy shall control. Notwithstanding any provision of the Privacy Policies, Entrants’ information may be shared with Sponsor’s marketing affiliates, sponsors and exhibitors and may be used for marketing purposes and/or to send follow-up communications to each Entrant and AMOE Entrant relating to Sponsor’s business. Participation in this Promotion constitutes your full and complete agreement to receive all such communications, subject to receipt of any opt-out requests related to email communications.

  14. Promotion and Sponsor. Participation in the Promotion constitutes Entrant’s full and unconditional agreement to these Official Rules. The Sponsor is National Marine Manufacturers Association, Inc., 231 S. LaSalle Street, Suite 2050, Chicago, IL, 60604. All decisions related to, as well as all interpretation of these Official Rules, shall be made by Sponsor and shall be final and binding. Apple Inc. is not a sponsor of this Sweepstakes and is not involved in this Sweepstakes in any manner.
